These Terms of Use (“Terms”) govern your access to and use of the CherryAI mobile application and related services (the “Services”) provided by Yanran, Inc. (“we”, “us”, “our”). Please read these Terms carefully before using the Services. If you do not agree, do not download or use CherryAI.
CherryAI provides AI-powered image generation tools, including text-to-image and image-to-image features, style templates, project history, and optional membership benefits. Features and availability may change without notice. We do not guarantee uninterrupted or error-free operation.
You must be at least the age required by Apple’s App Store terms in your region (the app is listed as 17+) and have the legal capacity to enter into these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
Your content. You are responsible for text prompts, photos, and other material you submit (“User Content”) and for AI-generated images or other output produced through the Services (“Output”). You retain ownership of your User Content to the extent permitted by law, subject to the licenses below.
License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and store User Content and Output as needed to operate, improve, and secure the Services (including sending images and prompts to our servers for AI processing).
Your responsibilities. You represent that you have all rights necessary to submit User Content and that your use complies with applicable laws. You must not submit content that:
AI limitations. Output is generated automatically and may be inaccurate, offensive, or similar to third-party works. You use Output at your own risk. We do not warrant that Output is unique, non-infringing, or suitable for any particular purpose.
Storage. Unlike apps that process images only on-device, CherryAI may upload photos and prompts to our servers to generate results and sync project history. Locally saved copies on your device remain under your control.
CherryAI offers optional auto-renewable subscriptions (such as weekly and yearly membership) processed by Apple. Payment, renewal, cancellation, and refunds are governed by Apple’s terms. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period in your Apple ID subscription settings.
Free users may have daily generation limits or intervals as shown in the app. Membership benefits, prices, and limits may change; we will display current terms at purchase where required.
You may use “Restore Purchases” where available to recover eligible subscriptions on the same Apple ID.

CherryAI, its logos, software, templates, and branding are owned by us or our licensors and protected by intellectual property laws. Except for the limited right to use the Services, no rights are granted to you.
We respect others’ intellectual property. If you believe content on the Services infringes your rights, send a notice to yanran_tech@163.com including: (a) identification of the copyrighted work; (b) identification of the material and its location; (c) your contact information; (d) a statement of good-faith belief; and (e) a statement under penalty of perjury that your notice is accurate and you are authorized to act.
The Services may include links, SDKs, or integrations from third parties (including Apple, advertising networks, and analytics providers). We are not responsible for third-party content or practices. Your use of third-party services is subject to their terms and privacy policies.
Non-members or certain features may display advertisements from us or partners. Ads may be personalized if you allow tracking under iOS settings.
Our collection and use of personal information is described in the CherryAI Privacy Policy. By using the Services, you agree to that Policy.
THE SERVICES AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless Yanran, Inc. and its affiliates from claims arising out of your User Content, Output, or violation of these Terms or applicable law.
We may suspend or terminate access to the Services at any time for violation of these Terms or to protect users and the platform. You may stop using the Services at any time. Sections that by nature should survive will survive termination.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise. Courts in San Francisco County, California shall have exclusive jurisdiction for disputes not subject to arbitration, unless prohibited by local law.
We may modify these Terms by posting an updated version with a new effective date. Continued use after changes constitutes acceptance.
